Welcome to WineLens. These Terms of Service ("Terms") govern your use of our mobile application for wine bottle recognition, AI sommelier consultation, and cellar management. By downloading, installing, or using WineLens, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using WineLens, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access or use our application.

Age Requirement

WineLens is intended exclusively for users who are of legal drinking age in their country or region of residence. By using the app, you confirm that you meet this age requirement. The app does not promote excessive consumption of alcohol; please drink responsibly.

Description of Service

WineLens is a mobile application that allows users to scan, identify, and manage wines using AI-powered label recognition. The app provides tasting notes, ratings, food pairing suggestions, market prices, and a personal AI sommelier to answer wine-related questions.

User Accounts

WineLens does not require user accounts or registration. Core features are available without creating an account. Optional cloud backup features may require sign-in via your device's identity provider.

Subscription Services

WineLens offers premium subscription services that unlock additional features and capabilities:

Premium Features:

  • Unlimited wine scans and recognition
  • Unlimited AI sommelier conversations
  • Advanced cellar analytics and insights
  • Price tracking and market alerts
  • Detailed expert tasting notes and reviews
  • Export your cellar to CSV or PDF
  • Priority customer support
  • Advanced filtering, search, and tagging

Subscription Plans:

  • Monthly Plan: $4.99 per month
  • Annual Plan: $39.99 per year (Save 33%)
  • Lifetime Plan: $99.99 one-time payment

Subscription Terms:

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and turn off auto-renewal in your Account Settings after purchase
  • Any unused portion of a free trial period will be forfeited when purchasing a subscription

In-App Purchases

WineLens offers various in-app purchases to enhance your experience:

Available Purchases:

  • Premium subscription plans (as described above)
  • Additional sommelier conversation credits
  • Premium expert wine database access
  • Advanced cellar management tools

Purchase Terms:

  • All purchases are final and non-refundable unless required by law
  • Prices may change at any time with notice
  • Purchases are processed through Apple App Store or Google Play Store
  • You agree to pay all charges at the prices then in effect

Free Trial

WineLens may offer free trial periods for premium features:

  • Free trials automatically convert to paid subscriptions unless cancelled
  • You can cancel at any time during the trial period
  • Trial periods are limited to one per user per feature

Refund Policy

Refunds for subscriptions and in-app purchases are handled according to the following policies:

  • iOS Users: Refunds are processed through Apple's App Store refund system
  • Android Users: Refunds are processed through Google Play Store policies
  • Contact the respective app store for refund requests
  • We do not process refunds directly

User Conduct

You agree not to:

  • Use the app for any illegal or unauthorized purpose
  • Attempt to reverse engineer or modify the app
  • Submit content that is harmful, offensive, or violates the rights of others
  • Interfere with or disrupt the app's functionality
  • Share your subscription credentials with others
  • Use the app to encourage underage drinking or excessive alcohol consumption

Intellectual Property

WineLens and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Recognition & Information Accuracy

While we strive for high accuracy in wine recognition, tasting notes, and pricing, we cannot guarantee 100% accuracy. Wines, labels, vintages, and prices change frequently. Users should verify important information independently before making purchase or collection decisions. Pairing and consumption suggestions are for informational purposes only and do not constitute medical advice.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the app, to understand our practices.

Disclaimers

The app is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free or uninterrupted. Wine ratings, prices, and market information are provided for informational purposes only and should not be considered as financial or investment advice.

Limitation of Liability

In no event shall WineLens be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Termination

We may terminate or suspend your access to the app immediately, without prior notice, for any reason, including breach of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date and posting the new Terms on our website.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the app is developed, without regard to its conflict of law provisions.

iOS App Store Specific Terms

For iOS users, these Terms are in addition to Apple's App Store Terms of Service. You acknowledge that:

  • Apple has no obligation to furnish any maintenance and support services
  • Apple is not responsible for addressing any claims by you or any third party
  • Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo
